Fitzzy LLC (“Fitzzy,” “we,” “us”) respects your privacy. This policy explains what personal information we collect when you use the Fitzzy website, mobile app, and related services (the “Services”), how we use it, when we may share it, and the choices you have.

1. Information we collect

Information you give us. When you create an account, list items, message other users, buy or sell on Fitzzy, we collect the information you provide — for example, your name, email, profile details, listing content, and shipping information. If you pay for or receive payment for a transaction, our payment processor collects the payment information directly and shares limited details with us to complete the transaction.

Information we collect automatically. We collect certain technical information when you use the Services, such as device and browser type, general location (usually derived from IP address), and how you interact with the Services. See section 4 and our Cookie Notice for more.

Information from third parties. We may receive information about you from partners who help us provide the Services (for example, payment, verification, and shipping partners) and from other users who interact with you on Fitzzy.

2. How we use it

We use your information to:

  • Provide and operate the Services, including creating accounts, showing listings, processing orders, and transferring payouts.
  • Keep the Services safe — detecting and preventing fraud, abuse, and violations of our terms. This includes scanning chat messages, listings, profile bios, and listing photos for attempts to move transactions off Fitzzy (payment app handles, phone numbers, off-platform coordination). Scanning is automated and combines pattern matching with a large-language-model classifier; confirmed violations are reviewed by our team.
  • Communicate with you about your account, orders, and updates to the Services.
  • Send you marketing communications (which you can opt out of at any time).
  • Personalize and improve the Services, including developing new features.
  • Meet our legal, regulatory, and compliance obligations and resolve disputes.

3. When we share it

We do not sell your personal information. We only share it in the limited circumstances described below.

Service providers. We work with trusted third parties that help us run the Services — for example, providers that handle payments, hosting, email delivery, shipping labels, fraud prevention, and analytics. These providers only receive the information they need to perform their function and are contractually required to protect it.

Other users. Certain information is visible to other users of Fitzzy so the marketplace can work — for example, your display name, profile, and public listing information are visible to anyone browsing Fitzzy. Once a sale is completed, we share the buyer's shipping information with the seller so they can fulfill the order.

Aggregated or de-identified information. We may share aggregated statistical or analytics information with third parties. Before disclosure, this information is aggregated or de-identified so it cannot reasonably be used to identify you.

Advertising partners. Where permitted by law, we may share limited information with advertising partners to help us reach potential users and understand the effectiveness of our advertising. Where required, we obtain your consent first; otherwise we rely on our legitimate interest to grow the Services. You may contact us to opt out of this sharing.

Legal reasons. We may disclose your information to law enforcement, regulators, courts, or other third parties where we believe in good faith that disclosure is required by law, is necessary to protect the rights, property, or safety of Fitzzy, our users, or others, or is necessary to detect, prevent, or investigate fraud, abuse, or violations of our terms.

Business reorganization. In the event of a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, your information may be transferred to a successor or affiliate as part of that transaction.

4. Cookies & tracking

We use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the Services are used. You can control cookies through your browser settings; disabling required cookies may break parts of the Services. For details, see our Cookie Notice.

5. Your rights & choices

Depending on where you live, you may have rights over the personal information we hold about you, including the right to:

  • Access — request a copy of the personal information we hold about you.
  • Correct — ask us to fix inaccurate information.
  • Delete — ask us to delete your account and information (subject to information we're required to keep for legal or compliance reasons).
  • Object or restrict — opt out of certain uses of your information, including marketing communications.
  • Portability — receive a copy of certain information in a portable format.
  • Not be discriminated against for exercising any of these rights.

California residents. Under the CCPA and CPRA, California residents have additional rights, including the right to know what categories of personal information we collect, use, and disclose. We do not sell personal information as defined by California law.

UK and EU residents. Under the UK GDPR and EU GDPR, our legal bases for processing your information include performance of a contract (running the marketplace), your consent (for example, marketing), our legitimate interests (for example, keeping the Services safe and improving them), and compliance with legal obligations. You have the right to lodge a complaint with your local data protection authority.

6. How long we keep data

We keep your information for as long as your account is active and for a reasonable period afterward to fulfill the purposes described in this policy, resolve disputes, enforce our agreements, and meet our legal obligations. Certain records — such as transaction and tax records — may be retained for longer periods as required by law.

7. Children

Fitzzy is not intended for anyone under 18, and we do not knowingly collect personal information from anyone under that age. If you believe a minor has signed up, email us at privacy@fitzzy.com and we'll take appropriate action, including closing the account.

8. International transfers

Fitzzy is operated from the United States. If you use the Services from outside the U.S., your information will be transferred to and processed in the U.S. and in other countries where we or our service providers operate. Where required, we use appropriate safeguards — such as standard contractual clauses — to protect that transfer.

9. Security

We use reasonable technical and organizational measures designed to protect your information, including encryption in transit, encryption at rest, and access controls. No system is completely secure, but we work continuously to protect the Services. If we ever experience a security incident affecting your information, we'll notify you and the appropriate authorities as required by law.

10. Changes to this policy

We may update this policy from time to time. If we make material changes, we'll notify you by email or through a prominent notice on the Services before the changes take effect. The “last updated” date at the top of this policy reflects the most recent revision.
